Welcome to Liam Caswell Coaching. By using our services, you agree to accept the following terms and conditions, please read them carefully as they apply to all use of our services.

  1. Services: We provide career coaching services to nurses and midwives helping them to navigate their personal and professional careers. This includes, but is not limited to, resume and cover letter writing and review, Selection criteria writing, interview preparation, and job search strategy, career planning and life coaching. Our team will never provide clinical advice or recommendations for implementation in clinical practice for our clients.

  2. Payment: Payment for our services must be made in full before the start of the coaching sessions. We accept payments via credit card, debit card, stripe, bank transfer. Where payment plans are implemented, services may be withheld were payments are missed or failed.

  3. Failed Payment: We reserve the right to engage the services of a collection agency in the event of a failed payment. If your payment fails, we will make immediate efforts to contact you and arrange for an alternative payment method. If payment is not received after three failed attempts, we may engage the services of a collection agency. Any costs associated with the collection agency will be passed on to the client. It's important to note that the engagement of a collection agency will be done as a last resort, and we will work with the client to find a solution before taking this step. In joining our programs, you are committing to knowing you have the means to pay for them.

  4. Late Payment Fee Policy: To ensure the smooth progress of our career coaching programs, adherence to the payment schedule agreed upon during sign-up and chosen by the client is crucial. Participants are required to make timely payments as outlined in the terms and conditions. Late payment fees will be applied for missed payments beyond the designated due date. A grace period of five (5) days will be provided after the original payment due date. After the fifth day of a missed payment, a late payment fee of $5 per day cumulative will be charged until the outstanding payment is made.

    Payment Reminders and Notifications: We understand that oversights can happen, and to assist participants in avoiding late payment fees, we will send payment reminders before the due date. These reminders will serve as a courtesy notification to ensure participants are aware of their upcoming payment obligations. In the event of a missed payment, participants will be promptly notified of the outstanding balance and the applied late payment fee. Notifications will be sent to the contact information provided during the enrollment process.

    Exceptional Circumstances and Modifications: We recognize that unforeseen circumstances can arise, impacting a participant's ability to make payments on time. In such cases, participants are encouraged to reach out to our customer support team as soon as possible. We may consider exceptions or reductions to the late payment fee on a case-by-case basis. It is important to note that consistent late payments may affect the participant's access to certain program resources or services until the outstanding balance, including any applicable late payment fees, is settled. Please be aware that we reserve the right to modify the late payment fee policy outlined in these terms and conditions, with any changes communicated to participants via email or other suitable means of notification.

  5. Refunds: We do not offer refunds for our any of services due to the nature of our program’s digital nature and the provision of application documents within the first 48 hours of our service. If you are not satisfied with our coaching services, application documents, we will work with you to address any issues and find a solution.

  6. Modification of Terms and Conditions: We reserve the right to make changes to these terms and conditions at any time. We will give a notice of any changes to the clients and coaches at least 30 days before the changes take effect. By continuing to use our services after any changes have been made, you are deemed to have accepted the new terms and conditions.

    It's important to review these terms and conditions periodically to stay informed of any changes. If you do not agree to any changes made to these terms and conditions, you must stop using our services.

  7. Confidentiality: All information shared during the coaching sessions will be kept confidential, except in cases where disclosure is required by law and the AHPRA code of conduct.

  8. Limitation of Liability: We will not be liable for any damages resulting from the use of our services. This includes, but is not limited to, damages resulting from a failure to secure a job or promotion. We will never provide any clinical advice relating to how you work as a nurse.

  9. Changes to Terms and Conditions: We reserve the right to make changes to these terms and conditions at any time. Your continued use of our services after any changes have been made constitutes acceptance of the new terms and conditions.

  10. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the state in Australia.

  12. Recording and Storage of Calls: We record all coaching sessions for quality control and training purposes. By participating in our coaching sessions, you understand and agree that your calls may be recorded and stored. The recordings will be kept confidential and will be used only for the purpose of improving our services and coaching techniques. It's important to note that in cases where calls are recorded, clients have the right to request a copy of the recording, or to have it deleted. If you have any concerns about the recording and storage of calls, please let us know before the start of the session.

  13. Communication Policy: We are committed to providing timely and effective communication with our clients. Our coaching sessions take place between Monday to Friday during business hours. We will not schedule any coaching calls on weekends, and any messages received over the weekend will be addressed on the following Monday morning. All communication between coaches and clients will take place via Kajabi direct messaging or email. We will make every effort to respond to client messages within 24 hours during business hours. It's important to note that coaches will not respond to any requests made over the weekend period. It is the clients responsibility to plan accordingly in accordance with job closing dates, providing at least 48 hours for the coach to provide support (not including weekends) before a deadline.

  14. Cancellation Policy: We understand that unforeseen circumstances can arise and you may need to cancel or reschedule a coaching session. To ensure fair usage of our time and resources, we have a minimum 24-hour cancellation policy for all coaching sessions. If you need to cancel or reschedule a session, please notify us at least 24 hours before the scheduled time. In case of a no-show or cancellation with less than 24 hours notice, we will work with you to reschedule. Please note that this policy applies to both coaches and clients. If a coach needs to cancel or reschedule a session, we will make every effort to provide a replacement coach or reschedule the session at a mutually convenient time.

  15. Disclaimer of Guarantee: It is important to note that our coaching services are designed to provide guidance and support in the job application process, but we cannot guarantee success in any of our programs, we can guarantee the quality of our work, support and deliverables. The job application process involves many factors beyond our control, including the qualifications and experience of other applicants, the hiring decisions of the employers, and other external factors. While we will make every effort to assist you in creating a strong job application, excellent interview, the ultimate outcome of the application process is beyond our control. We are committed to helping you achieve your goal.

  16. Indemnity: You agree to indemnify and hold us, our coaches, directors, officers, employees and agents, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of our services, your violation of these terms and conditions, or your violation of any rights of another. This means that you will be responsible for any losses or damages that we may suffer as a result of your actions or inactions. This includes but not limited to, any legal fees that may arise from any claim or dispute with a third party.

  17. Testimonials: We may ask you to provide a testimonial about your experience with our services. By providing a testimonial, you grant us the right to use your testimonial for marketing and promotional purposes, including but not limited to, our website, social media platforms, and other marketing materials. We will include your first name and last initial and your occupation. You have the right to request that your testimonial be removed or modified at any time by contacting us. It's important to note that we will never publish any testimonial without your consent and we will always respect your privacy and confidentiality

  18. .Intellectual Property: Our coaching services and materials, including but not limited to, resumes, cover letters, selection criteria, and interview preparation materials, are protected by copyright laws. All intellectual property rights in these materials belong to us. By using our services, you agree that you will not reproduce, distribute, or display any of our materials without our express written consent. You also agree that you will not use any of our materials for any commercial purposes or for the benefit of any third party without our express written consent. We retain the right to use any materials produced during the coaching sessions for promotional and marketing purposes, unless you request otherwise.

    Violation of our intellectual property rights may result in legal action. It's important to note that while we will provide guidance and feedback on your job application materials, it is ultimately the responsibility of the client to ensure that the information provided is accurate and appropriate for the job they are applying for. Our coaching services do not guarantee the success of any job application. You have the right to use and reuse your application documents provided by LCC Coaching.

  19. Inappropriate Behavior Policy: We have a zero tolerance policy towards any form of inappropriate behavior, including but not limited to discrimination, harassment, hate speech, and bullying. This policy applies to all interactions between clients, coaches, and other members of our programs, communities, and coaching sessions.

    We are committed to creating a safe and inclusive environment for all of our clients and coaches, and we expect all participants to treat each other with respect and professionalism. Any behavior that is deemed to be inappropriate will result in immediate removal from the program, community, or coaching session without refund.

    We will not tolerate any form of discrimination or harassment based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, age, or disability. If you experience or witness any inappropriate behavior, please report it to us immediately.

    We take this matter seriously and will take appropriate action to ensure that our clients and coaches feel safe and respected while they are working with us.

  20. Bonus Coaching Packages: We may offer additional coaching services or packages that are not included in the standard program or service packages. These additional services may include, but are not limited to, additional coaching sessions, application reviews, interview preparation, and job search strategy guidance.

    Clients have the option to purchase these bonus coaching packages at any time during the program. The cost of the bonus coaching packages will be in addition to the cost of the standard program or service package.

    It's important to note that the bonus coaching packages are optional and are not required for successful completion of the program. However, they may be beneficial for clients who want additional support or guidance in their job search.

Program Specific Terms

Application Support Program terms:

Our Application Support Program is designed to support clients with one job application and interview process, from start to finish. The program includes, but is not limited to, review and editing of one CV, one cover letter, and one selection criteria document. Clients will also receive interview preparation and job search strategy guidance. It's important to note that while we will provide guidance and feedback on your job application materials, it is ultimately the client's responsibility to ensure that the information provided is accurate and appropriate for the job they are applying for. Our coaching services do not guarantee the success of any job application.

The clients will have lifetime access to the course and future upgrades. Additional coaching for any extra job applications and interviews will incur additional fees.

It's important to note that the program is designed to support one job application only and additional support for extra job applications will require additional fees.

All ASP clients will have lifetime access to this program modules, future application support will be at an additional cost.

Nurse Career Academy (Grads) terms:

Our NCA (Grads) is a 12 month long program that provides support with all job applications and interviews as advertised. This program includes, but is not limited to, review and editing of multiple CVs, cover letters, and selection criteria documents. Clients will also receive interview preparation, job search strategy guidance and access to an exclusive community of like-minded individuals.

It's important to note that the program has specific deadlines that must be adhered to for coaches and clients to successfully deliver on application outcomes. We expect clients to be proactive and to meet the deadlines for the program.

We do not offer refunds for the NCA program. Liam Caswell Coaching reserves the right to cancel access to the NCA program for any failed payments or poor behaviour, voiding the guarantee offered.

It's important to note that the NCA program is a comprehensive program that requires a significant time and effort from both the coaches and clients. This program has a 100% risk free investment guarantee - we work with you until you land your first graduate job. Whilst we cant guarantee or control recruitment panels, we can guarantee your applications will be exceptional and that we will work with you until you land your first job, considering you put in the time, effort, show up to calls, complete the course and workbook and use the support available.

All NCA grad clients will have lifetime access to this program and are not under any circumstance permitted to share their access with non NCA nurses, if they do, this will result in immediate cancellation.

NCA All Access Tier Terms

1. Access to Courses and Content

All Access members are granted full access to all courses and content within the Nurse Career Academy (NCA). This includes all updates and new content released during the membership period.

2. Access to Community

Members will have access to our exclusive community platform, where they can engage with other members and participate in discussions and activities that enhance their professional development.

3. Live Call Support with Liam

All Access members are entitled to support and reviews from Liam during scheduled live calls. Members must present their applications and questions during these sessions for review and guidance.

4. Email Restrictions

All Access members are not permitted to email their applications directly to Liam for review. as this is a VIP service option only. All reviews and support must be conducted during the designated live calls as part of the NCA program.

5. All Access Bonus: Personalised Review

Members who sign up and qualify for the All Access Bonus will receive one personalized review from Liam, which includes video feedback for one application package (1 x CV/Cover Letter/Selection Criteria) for one specific role. This bonus review:

Must be claimed and used within the duration of the program.

Cannot be carried over beyond the end of the membership period.

Is not exchangeable for any other service or cash equivalent.

Is contingent upon the member first updating their documents with NCA-provided material and having obtained preliminary support through the community or live calls.

6. Program Completion Requirements

The NCA All Access guarantee to work with a client is contingent upon the following:

Complete 100% of the online course material.

Attendance at a minimum of six live support calls during the membership period.

Active participation in the community, evidenced by at least four posts seeking support or engaging with other members.

7. Guarantee Validity

The NCA All Access guarantee is valid for ten months from the date of agreement. The guarantee is void if the member fails to meet the program completion requirements outlined above.

  5. Maximizing the Program: To fully benefit from the Grad 1:1 Coaching Support, we recommend using the sessions for ongoing support, accountability, and guidance as you implement your career strategies, navigate job applications, interviews, and transition into new roles or responsibilities.

  6. Booking Sessions: Clients will have access to an online booking system to schedule their coaching sessions. We recommend planning ahead to ensure availability and to align the sessions with your career development needs.

Please note that the 12 coaching sessions provided as part of this program are non-transferable and must be used within 12 months of the sign-up date. Failure to use all sessions within this timeframe will result in forfeiture of the remaining sessions, without the possibility of extension or refund.

Engagement and Client Responsibility

By enrolling in our business coaching program, you agree to:

Actively participate in all coaching sessions.

Implement the strategies, tools, and frameworks discussed.

Complete all assignments and action steps within the provided timelines.

We provide guidance, support, and expert advice, but your success depends on your commitment, participation, and the execution of strategies.

Terms of the Guarantee:

Participation:

Scheduling and Cancellations

Coaching sessions must be scheduled within the 12-month program timeframe. It is the client’s responsibility to schedule these sessions.

Cancellations: A minimum of 24 hours' notice is required for cancellations or rescheduling of coaching sessions. Failure to provide timely notice will result in the session being forfeited without reimbursement or rescheduling.

Payment and Refunds

All payments for coaching services are required upfront. Due to the nature of the coaching, and the time and resources involved:

No refunds will be provided once the program has commenced, regardless of participation or results.

The program fee covers the coaching services as described and cannot be refunded or transferred.

Limitation of Liability

By engaging in this coaching program, you agree that LCC Coaching is not liable for any business losses, damages, or negative outcomes resulting from your participation. You accept full responsibility for your decisions, actions, and the results of your business. The coaching is provided as guidance and support, but success is dependent on many factors outside of our control, including market conditions and your implementation.

No Guarantee of Financial Results

While we provide strategies, guidance, and support aimed at helping you grow your business, LCC Coaching makes no guarantee of specific financial results, including 5-figure months. Results vary based on individual effort, market conditions, and external factors.

The 5-Figure Nurse Entrepreneur Foundations Guarantee is conditional upon full participation and implementation as outlined above. If these conditions are not met, the guarantee is void.

Legal Disclaimer

LCC Coaching provides business coaching services, not financial or legal advice. You agree that you will not hold LCC Coaching liable for any business, legal, or financial decisions you make during or after the program.

Agreement to Terms

By enrolling in and engaging with LCC Coaching, you acknowledge and agree to these terms and conditions. Any breach of these terms may result in the termination of services without refund.

Terms and Conditions for Done-For-You Tech Build-Out

Engagement and Client Responsibility:

By engaging in the Done-For-You Tech Build-Out, you agree to:

Provide timely feedback, materials, and information required for each step of the build-out.

Actively participate in the setup process by attending scheduled review and handover sessions.

Ensure all content (e.g., copy and images) is ready for implementation according to the project timeline.

Timeline and Deliverables:

Project Timeline:

The build-out process will occur over a timeline agreed upon at the project’s initiation, based on the client’s responsiveness and availability of required materials.

Delays in client response or failure to provide necessary information may result in timeline extensions without penalty to LCC.

Revisions:

The package includes up to two rounds of minor revisions for each page within the scope. Additional revisions or changes beyond scope may incur additional fees.

Design and Aesthetic Limitations:

The design of the website is guided but not customized beyond the scope described (e.g., advanced graphics, custom layouts). Full design customization may be available for an additional fee.

Final Approval:

Upon project completion, you will have a final review session to sign off on deliverables. Any additional changes requested post-approval will be treated as a new project or billed separately.

Payment and Refunds:

Payment Terms: Full payment is required upfront to initiate the Done-For-You Tech Build-Out.

Refund Policy: Due to the nature of this customized service, no refunds will be provided once the build-out process begins.

Limitations of Liability:

Scope of Service: LCC is responsible for providing only the services and deliverables outlined in the Scope of Work. Any additional requests outside the defined scope will require a separate agreement.

Client Content: LCC is not liable for any issues related to client-provided content, including but not limited to copyright infringement, factual accuracy, or content quality.

Third-Party Tools: LCC is not responsible for any downtime, malfunctions, or updates to third-party tools and platforms (e.g., email marketing platforms, ManyChat, Zapier) that may impact the setup’s functionality.

Platform and Subscription Costs: LCC is not responsible for the costs associated with any platforms, tools, or subscriptions required to complete the tech setup. These costs are additional and will be incurred by the client above the price of the Done-For-You Tech Build-Out.

Ongoing Maintenance:

Post-Launch: LCC provides a tech handover and guidance on maintaining your website and systems. Ongoing maintenance, updates, or support are not included in the Done-For-You package but can be provided as a separate service.

Confidentiality:

All client information, materials, and business details shared for the purposes of the Done-For-You Tech Build-Out will be kept confidential and not shared with third parties, except as required to complete the services or as required by law.

Acceptance of Terms:

By engaging LCC for the Done-For-You Tech Build-Out, you acknowledge and agree to the terms and conditions outlined above. Any disputes, modifications, or additional service requests must be mutually agreed upon in writing.

Final Disclaimer

Liam Caswell Coaching (LCC) provides comprehensive career and business coaching services tailored specifically for nurses and healthcare professionals. Our programs, guidance, and resources are designed with the intention of supporting our clients in achieving their personal and professional objectives.

It is important to acknowledge, however, that the success and outcomes of career advancements, job acquisitions, business growth, or any other professional endeavors undertaken by clients following our coaching or as a result of using our services are influenced by a multitude of factors beyond our control. These factors may include, but are not limited to, individual client efforts, market dynamics, employment opportunities, personal circumstances, and the competitive nature of the healthcare industry.

Therefore, LCC explicitly waives any responsibility for the direct or indirect outcomes, successes, or failures experienced by clients as a result of applying the advice, strategies, or tools provided during our coaching sessions or through our materials. Our role is to support, guide, and equip our clients with the necessary tools and knowledge to navigate their professional journeys. The implementation, execution, and outcomes of such guidance rest solely with the individual client.

Clients are encouraged to approach their professional development proactively, utilizing LCC's coaching and resources as one component of a broader personal and professional strategy. Success in one's career or business endeavors is the result of a combination of personal effort, external circumstances, and continued professional development.

By engaging with LCC's services, clients agree to this disclaimer, acknowledging the inherent uncertainties in career and business outcomes and absolving LCC of responsibility for the results of their professional endeavors.
